These Terms of Service ("Terms") govern your use of the Zyvara Technologies website at zyvaratechnologies.com and the services, packages, and custom projects offered through it. Zyvara Technologies LLC ("Zyvara," "we," "us," "our") is a member-managed limited liability company registered in the State of Missouri, USA. By using this website, you agree to these Terms.

Who we are, and ZySurveys

Zyvara Technologies LLC builds websites, custom software, and GPT/rewards platforms for clients, and separately builds and operates ZySurveys, our own online survey and rewards platform, at zysurveys.com. This document governs zyvaratechnologies.com. ZySurveys is a distinct consumer product with its own Terms of Service, Privacy Policy, and Cookie Policy, published at zysurveys.com. Where this document discusses ZySurveys, it does so for transparency about who operates the platform — the operative terms for using ZySurveys as a consumer are the ones published on zysurveys.com.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to create an account or order services on this website.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when creating an account or placing an order, and to notify us promptly of any unauthorized use of your account.

Services

Zyvara sells fixed-price website packages, custom-quoted development services, and ongoing care/support plans, as described on our Services pages. Fixed-price packages may be added to a cart and ordered directly. Custom-quote services are scoped through our "Build With Us" inquiry flow and are only invoiced once we've agreed on scope and price with you.

Orders and pricing

Prices shown for a package are captured on your order at the time you order — later changes to our published prices do not change the price of an order you've already placed. Orders remain "Awaiting Payment" until a payment is arranged and confirmed; see our Refund and Cancellation Policy for details.

Payment

We do not currently process live card payments through this website. Payments are arranged and confirmed manually and recorded against your order by our team. We will never display a payment button that cannot actually process a payment.

ZySurveys: survey participation and third-party providers

ZySurveys connects users with survey and offer opportunities supplied by third-party survey, market-research, and offerwall partners. If you use ZySurveys, you acknowledge that:

• Survey and offer availability, targeting, and qualification are determined by third-party providers and are not guaranteed — they vary by user profile, geographic market, and provider inventory.
• Rewards are credited only for activity that a provider verifies as valid and complete, are subject to the terms of the applicable offer, and may be reduced, delayed, rejected, or reversed by a provider that determines activity to be invalid, duplicated, incomplete, or fraudulent.
• Use of ZySurveys is governed by the ZySurveys Terms of Service published at zysurveys.com, which take precedence over this section for anything specific to the ZySurveys platform.

Acceptable use

Use of this website and our services is subject to our Acceptable Use Policy. Without limiting that policy, you agree not to misuse this website, attempt unauthorized access to our systems or other users' accounts, submit fraudulent order, payment, or survey-related information, or use automated means to abuse our forms or services.

Prohibited activity, fraud, and abuse

We reserve the right to investigate suspected fraud, abuse, duplicate accounts, or violations of these Terms, and to take appropriate action, including declining an order, withholding a reward pending verification, or suspending or terminating an account.

Account suspension and termination

We may suspend or terminate your account or access to this website, with or without notice, if we reasonably believe you have violated these Terms, our Acceptable Use Policy, or applicable law, or engaged in fraudulent or abusive activity.

Intellectual property

This website, its design, and its content are owned by Zyvara Technologies LLC or its licensors and are protected by applicable intellectual property laws. Deliverables for custom development work are governed by the scope agreement for that project. You may not copy, reproduce, or use our branding, content, or code except as permitted by these Terms or a separate written agreement.

Third-party services

This website and ZySurveys may rely on or link to third-party services, including survey and research partners, offerwall providers, reward and payment processors, and email delivery providers. We are not responsible for the content, policies, or practices of third-party services, and your use of them is subject to their own terms.

Disclaimers

This website and our services are provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not guarantee that this website will be uninterrupted, error-free, or secure, and we do not guarantee survey availability, qualification, or earnings on ZySurveys.

Limitation of liability

To the maximum extent permitted by Missouri law, Zyvara Technologies LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of this website or our services, and our total liability for any claim is limited to the amount you paid us for the service giving rise to the claim in the twelve months before the claim arose.

Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted to this page; the "Last updated" note above reflects the most recent revision. Continued use of this website after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles, and any dispute arising from these Terms is subject to the jurisdiction of the courts located in Missouri.
